Terms and Conditions

Terms & Conditions for Equipment Hire

General Terms
The following terms and conditions apply to you, The Hirer for any hire we may make to you. For the purposes of this agreement and the terms that now follow, the Hirer is considered to be the person who signs the booking form. The following terms apply to all bookings taken on www.a1proents.com or over the telephone, email, or by letter or fax and are general overriding conditions of hire.
By placing a booking with A1 Pro Entertainments the hirer warrants that:
(a) They are over 18 years of age and are legally authorised to place such a booking.
(b) That they have read, understood and have agreed to all of the terms and conditions applicable to any such hire or service.
(c) That they accept that prices may fluctaute and that the price they have paid is the price for the service as quoted at the time of hire.
(d) That they accept any other third party service providers terms applicable to their booking.

Booking With Us
You are welcome to place a booking with us, online, over the phone, by telephone or fax. Whichever method of booking you select, you are, by booking with us, agreeing and are accepting the following terms and conditions of service and sale. A booking is final when we receive the completed and signed Booking form. Once we receive your booking form we will confirm our acceptance of the booking back to you by email. If you have not received a confirmation from us then you have no booking with our company.

Payments and Holding Deposit
When you hire equipment from us we will deliver and set up the equipment and show you the items working and give you a quick guide as to operation. At this point you will need to pay our installer in Cash (unless prior arrangements have been made) the full amount of the agreed hire charge and also a holding deposit which is our guaruntee that you will take responsibility for the safe and secure upkeep, operation and storage of the equipment. The amount of the requested deposit will be agreed with you before we arive and will vary according to the total replacement value of the items you are hiring from us. Your deposit is held in the unlikely event of any damage, loss or theft which may occur during the period of hire. This deposit will cover most minor instances of damage or loss. During and after collection of the equipment A1 Pro Entertainments Staff will check all hire items and assuming there is no loss or damage caused by the hirer we will refund your deposit in full. Should any damage or loss be noted at the time of collection or return to our premises then the hirer named on the booking form is personally liable to make good the cost of such damage or loss and should the retained deposit amount not cover the full replacement costs or loss incurred by us then A1 Pro Entertainments will seek to obtain the full replacement costs from the hirer.

Delivery of Equipment
A1 Pro Entertainments deliver set up and test all equipment prior to use. If the named hirer, as shown on the booking form, is unavailable to check the supplied equipment after it has been installed. A1 Pro Entertainments will not be held responsible for any operational problems, loss or damage that may occur during the hire period. If any technical issues occur during the hire period please call us so that we are given the opportunity to resolve any issues prior to or during use. A1 pro Entertaiments do not make refunds for retrospectivly reported faults. If A1 Pro Entertainments are called out to attend the event and the fault is found to be an error caused by the hirer, misuse of equipment or loss of equipment by the hirer, thier agents or staff then a call out fee of at least £75.00 per occurance in addition to Parking Fees, Congestion Charges and any other expenses incurred by our staff in attendance of the reported failure will be charged to the hirer.

Cancellation of Hire
The Hirer is responsible to notify A1 Pro Entertainments of any impending cancellation of event or hire. Cancellation must be in writing, by the hirer via email or letter giving at least 48 hours notice of intention to cancel the hire. Should cancellation occur and be notified to us more than 48 hours before the agreed delivery date and time then A1 Pro Entertainments will refund in full any fees paid in advance by the hirer. If cancellation is requested by the hirer within 48 hours of the agreed delivery time then A1 Pro Entertainments reserve the right to request payment in full. If cancellation is requested on the day of the agreed delivery or during the hire period then no refunds will be given under any circumstances.

Parking Charges & Fees
The Hirer is responsible for the provision of safe and authorised parking of our vehicles for the purposes of delivery, set up and collection of our equipment. If parking provisions cannot be provided by the hirer the hirer will be liable for any parking charges that may occur.

Force Majeur
Occasionally circumstances beyond our control will affect a booking you have placed with us. A1 Pro Entertainments shall not be liable for:
(a) any damage to or loss of the hirer's property unless such damage or loss has occurred as a result of the willful neglect of A1 Pro Entertainments staff;
(b) any of the hirer’s guests, staff and or agents’ indirect, special or consequential losses (for example, cancellation of event, transport or accommodation costs).
In addition A1 Pro Entertainments shall not be liable to the hirer for:
(a) any expenses or losses incurred by the hirer; or
(b) any delay or non-performance of equipment or our obligations to the hirer, if and to the extent that such expenses or losses, delay or non-performance are caused by a Force Majeure Event. “Force Majeure Event” shall mean any event or circumstance which is reasonably beyond A1 Pro Entertainments control, including without limitation, traffic congestion, parking difficulties, Act of God, terrorist action, imminent threat of terrorist action, epidemic, wars, national emergencies, insurrections, riots, fire, flood, suspension of power leading to inoperability of the venue, loss of utilities, national mourning, strike, industrial action, lock out, breakdown, malfunction or damage of or to the venue, any plant, equipment or materials, explosion, civil commotion or disturbance, interruption in, delay or failure of necessary transportation or technical facilities, severe weather conditions or act of local or national government.
Nothing in these terms and conditions shall exclude either party’s liability for death or personal injury caused by its negligence, fraud or fraudulent misrepresentation or any other liability which cannot be excluded by law.
The hirer shall be liable for, and shall indemnify A1 Pro Entertainments against, any loss or damage caused to both our hire eqipment and the venue furniture, fixtures and/or equipment which may arise as a result of the hirer’s use of the venue or from items being brought into the venue by the hirer, the hirer's guests, staff and or agents, excluding any loss or damage directly caused by the venue staff or agents.

Limitation of Liability
It is a implied and specific term of hire that A1 Pro Entertainments
(a) are imdemnified against any liability or costs by the hirer, howsover caused, resultant from the hire of equipment; and
(b) the limit of A1 Pro Entertainmenst liability in any case is the total amount paid to A1 Pro Entertainments as the hire charge.

Effect of Non Compliance
If the hirer does not comply with these terms and conditions:
(a) the hirer shall allow access to and the safe return of A1 Pro Entertainments equipment; and
(b) the hirer shall pay in full for any loss or damage incurred by A1 Pro Entertainments.

These terms and conditions shall be governed by and construed in accordance with English law. Any dispute in relation to their subject matter shall be submitted to the courts of England. If you do not agree to these terms and conditions do not book or reserve any service hire package with us.
